Unfortunately, many construction businesses enter into contracts without fully understanding the obligations of the contract or the possible detrimental financial implications that the agreement can impose. 

Therefore, to help businesses understand the complexity of contracts and to avoid contractual disputes, the Confederation of Construction Specialists has developed a variety of training courses that should be undertaken by anyone that works with contracts. 

Our experienced tutors offer years of accumulated knowledge and a thorough understanding of contract issues that enrich our courses and augment the learning experience.

Arden University - Construction Contractual Dispute Avoidance Course

CANDIDATES

This Arden University backed Construction Contractual Dispute Avoidance qualification has been designed specifically to provide a broad appeal and is targeted at all construction staff involved in any aspect of working with subcontracts or supply contracts.

DELIVERY AND ASSESSMENT

The Construction Contractual Dispute Avoidance programme is delivered at several of the Confederation's training venues.

There are 6 modules to obtaining the qualification:

 1 - 'Introduction to Contracts'

 2 - 'Supervising and Managing Specialist Construction Work'

 3 - 'Obtaining Payment'

 4 - 'An Alternative Form of Contract'

 5 - 'Handling Claims and Disputes'

 6 - 'Specialist Subcontract Management'

 1, 2, 3, 4, 5 are delivered through 1 day tutorials and unit 6 is spread over 2 tutorial days.

At the completion of each module, candidates are given an assignment to complete. Lecturers will mark the assignments and give feedback and provide on-line support in case of difficulties. The University's verification process check a representative sample of marked assignments for consistency. The verification process also includes annual quality assurance audits.

In order to provide the best possible training solutions and provide enhanced focus on the specific training needs of an organisation the Confederation offers its “In-house” training service.

Offering greater flexibility and held at the client's premises, or a suitable alternate venue, this approach allows for maximum focus to be provided on specific training requirements. It also offers the opportunity to reduce the impact of days out of the office, travel and accommodation costs.

We have recently held a number of bespoke courses for companies representing differing sectors of the construction industry, and for construction associations.

The fees include the cost of all documentation and administration. The course fee will be invoiced prior to the course date and is payable at least 2 weeks before the course date. The fees quoted above will apply until 31 December 2017.

Expenses and Costs

Overnight accommodation (if required) will be charged based on location and rates applicable.

For in-house courses, companies will be required to provide a suitable venue (with chairs and tables, preferably set up in a classroom or similar style).

Meet the Lecturers

MARK STANDLEY MSc

Mark delivers all courses based at the Aldershot location. Mark started his career in the construction industry working as a mechanical and electrical quantity surveyor. After gaining extensive experience working for major contractors and also working within a busy contract claims department, he worked as a PQS, setting cost plan budgets and analysing contractor's Final Accounts. Mark moved into consultancy in 1988.

Joining Maitland QS in 1992, Mark was appointed director in 1996 and is now jointly responsible for the overall success and expansion of the business and continues to work on matters of dispute resolution and claims recovery. In 2002 Mark became an accredited Mediator.


Colin Hale MRICS

Colin delivers all courses from our Northern office in Halifax, further afield in the North & North West region and at individual company premises for in house training where requested. Colin started his career with a major contractor as an articled pupil and on qualifying decided that a more interesting career could be attained with specialist contractors and has devoted his time to representing specialist contractors ever since.

Fully conversant in all the standard forms of contract, and more usefully most of the hybrid subcontracts preferred by main contractors, Colin is a highly experienced settlement negotiator and now concentrates on offering construction contract advice and representing specialist contractors in adjudication and mediation as well as other ADR methods.


Andrew Redfern Bsc (Hons)

Andrew delivers all courses based at the Burton-on-Trent location and at individual company premises for in house training where requested. Andrew has worked as a Quantity Surveyor and Commercial Manager for, and on behalf of , Specialist Contractors for 17 years, including Andover Controls, TAC and Tyco/ADT.

In 2002 Andrew formed Redfern Contract Consultants, with the aim to support and assist Specialist Contractors by providing Commercial and Project Management, Quantity Surveying, Planning and Dispute Avoidance advice and expertise. Andrew has had ‘hands on’ experience in many specialist contracting sectors including BMS, Fire and Security, Asbestos removal, Audio & Visual, Roofing, Flooring and Electrical Installation.


 Howard Klein (FCIArb, FCIOB, FCinstCES, MRICS) 

Howard delivers courses from our Warrington and Corby venues and at company premises. Howard is a Chartered Arbitrator, Accredited Adjudicator, Chartered Construction Manager and Chartered Quantity Surveyor with over 30 years’ experience as a main contractors’ commercial manager before commencing his own practice in 1991 providing commercial and contractual support to contractors and sub-contractors to avoid disputes or to assist in resolving disputes by representing parties. Also an accredited expert witness advising upon extensions of time, valuations and costs of events leading to direct cost and prolongation cost claims.

 


 

Training Course Booking Conditions

  • All course fees are payable in full at time of reservation, unless agreed otherwise.
  • A refund of 80% of the amount of fees paid will be made in the event of receipt of written cancellation at least THREE weeks prior to the date of the course. No refund can be made on cancellation thereafter.
  • Substitution of delegates (from the same company/firm) can be made at any time prior to the start of the course.
  • All course documentation is provided solely for the private training and study purposes of individual delegates. Copyright is reserved in all material prepared and provided by the Confederation.
  • The Confederation reserves the right to make any alterations to course arrangements necessitated by circumstances beyond its control.
  • All Arden University candidates must attend all modules and pass all assignments on their booked course to be awarded the Arden University certificate. However, if a candidate misses a module on their booked course, the Confederation, at its discretion, may allow the candidate to attend the missed module on a future Arden University course at the same venue.
